TERMS AND CONDITIONS OF PARTICIPATION

The terms and conditions for this Competition have been deposited with Athens-based notary public Haralambos Fotopoulos, 47 Solonos St., GR-10672, tel. 210 3617704, and Deed No 588/8.12.2016 has been drafted regarding the deposit of the Terms and Conditions of Participation in the Competition.

Scope of the Competition – Organisation

1. The company with the corporate name "AEGEAN AIRLINES S.A.", whose registered offices are at 31 Viltanioti St., Kifissia, Attica (hereinafter the "Organiser"), is organising a “New Miles+Bonus collaboration with Santa Claus" competition / promotion (hereinafter the "Competition"), through its website http://www.aegeanair.com. The competition / promotion will start at 14:00 hours on Thursday, 8 December 2016 and will end at 12:00 hours on Monday, 9 January 2017, and (22) lucky winners will be chosen by draw on Tuesday, 10 January 2017.
   
   The Organiser invites the visitors of Aegean’s website (www.aegeanair.com) that will register to Miles+Βonus or sign in to their Miles+Bonus account throughout the duration of the competition, to participate in a draw, after reading the complete terms and conditions of the Competition here (aegeanair.com), to win one of the following prizes.
   
   The 22 winners of the draw to be carried out by AEGEAN via www.random.org on 10 January 2017, at 12:00 hours, must provide proof of identification with respect to the information they entered upon registration to Miles+Bonus. The winners must be Miles+Bonus members that registered or signed in to their account during the Competition and stated that they wish to participate in the draw. The competition will be held exclusively via the internet, by filling in the Miles+Βonus registration form or signing in to an existing Miles+Βonus member account. Each participant can enter the draw only once.
   
   The Organiser assumes no obligation to secure or facilitate access to Internet sites or to provide the relevant facilities to any interested party with respect to their participation in the Competition. Access to the Competition website is only permitted under the operating terms and conditions for the relevant server and the technical and other conditions and specifications for the Competition. The Organiser hereby assumes that each participant is the subject of, and has exclusive control over, the personal data he/she provided. The Organiser shall not be liable for any charges to the participants/users due to the aforementioned grounds.
2. Eligibility
   Anyone over the age of 18 is eligible to participate in the promotion / Competition. Individuals falling into the following categories are excluded from the Competition:
   (a) anyone under the age of 18;
   (b) anyone who has expressly not agreed to these terms and conditions of use;
   (c) employees of the Organiser;
   (d) the employees of the Organiser’s affiliates, and
   (e) first- and second-degree relatives of the employees referred to in paragraphs (c) and (d) above and the spouses of said employees. In such cases, the aforementioned companies shall not be liable to any individual due to inappropriate use of this service. The Organiser reserves the right (but is not required) to exclude from the Competition, at any stage of the Competition, persons who, in its view, may have used (or attempted to use) unlawful means regarding their participation or who breach a term of this article. "Unlawful" shall mean, inter alia, cooperation with other persons, use of devices, arrays, computers and/or software to facilitate automated or multiple participations without human intervention, and so on. In all events, the Organiser may exclude any user/visitor/participant from the Competition using any lawful means. It is hereby specified that participation in the Competition does not require purchase of any product and that no fee is to be paid by the participants. Participation in this promotion is conditional upon access of the participants to the Internet using their own technical means. It shall be voluntary and requires prior agreement of the participants with the terms of the Competition.
3. Prizes - Draw
   The Competition winners will receive the following prizes:
   1st : 200,000 Miles+Bonus award miles
   2nd : 200,000 Miles+Bonus award miles
   3d : 200,000 Miles+Bonus award miles
   4th : 200,000 Miles+Bonus award miles
   5th : 200,000 Miles+Bonus award miles
   6th : A 3-day stay (2 nights) for 2 in a suite at Hotel Grande Bretagne, with breakfast, as well as two (2) round-trip airline tickets on a flight operated by the Organiser, for the winner and his/her companion, from their place of residence to Athens airport.
   7th : A 5-day stay (4 nights) for 2 in a Deluxe sea view room at Sheraton Rhodes Resort, with half board, as well as two (2) round-trip airline tickets on a flight operated by the Organiser or its subsidiary with the distinctive title Olympic Air, for the winner and his/her companion, from their place of residence to Rhodes airport.
   8th : A 4-day stay (3 nights) for 2 in a suite at Blue Palace, a Luxury Collection Resort and Spa, Crete, with breakfast, as well as two (2) round-trip airline tickets on a flight operated by the Organiser and/or its subsidiary with the distinctive title Olympic Air, for the winner and his/her companion, from their place of residence to Heraklion airport. 9th : A 3-day stay (2 nights) for 2 in a Deluxe room at Westin Costa Navarino, with breakfast, as well as two (2) round-trip airline tickets on a flight operated by the Organiser or its subsidiary with the distinctive title Olympic Air, for the winner and his/her companion, from their place of residence to Kalamata airport. 10th : A 3-day stay (2 nights) for 2 in a Deluxe room at Santa Marina, a Luxury Collection Resort, with breakfast, as well as two (2) round-trip airline tickets on a flight operated by the Organiser or its subsidiary with the distinctive title Olympic Air, for the winner and his/her companion, from their place of residence to Mykonos airport.
   11th : A 4-day stay (3 nights) for 2 in the Dorian Suite at Vedema Resort, with breakfast, as well as two (2) round-trip airline tickets on a flight operated by the Organiser, for the winner and his/her companion, from their place of residence to Santorini airport.
   12th : an iphone 7 32 GB from COSMOTE
   13th : an iphone 7 32 GB from COSMOTE
   14th : an iphone 7 32 GB from COSMOTE
   15th : a 3-day class B car rental from Hertz Autohellas

   19th : a €250 gift voucher for Hellenic Duty Free Shops in Greece

   22nd : a €250 gift voucher for Hellenic Duty Free Shops in Greece
   
   Winners will be selected through an electronic draw from among all entries. The draws will be held at Aegean’s offices at 31 Viltanioti St, GR-14564 Kifissia, on Tuesday, 10 January 2017, at 12:00 hours. One (1) winner and one (1) runner up will be selected in each draw for each prize The Organizer will process the entries in the competition and conduct the draw for the winners. The web tool to be used for the draw is http://www.random.org/.
   
   Any participant can be declared a winner only once and receive his/her Prize only once. The winner of the Competition may not designate a substitute to receive the Prize nor request exchange of the Prize against money or any other replaceable items.
   
   If it is not possible to communicate with a winner for any reason for up to 5 business days from the date of the draw (including as a result of chance and force majeure events), then the Organiser is released from any obligation towards that specific winner.
   
   Where the Organiser does contact the winner, he/she will be asked over the phone to provide the minimum personal data necessary so that all further steps can be taken with regard to the Prizes (announcement, dispatch of Prizes, etc.). In particular, the Organiser will send to each Competition winner a letter with detailed instructions on how to receive his/her Prize. It is hereby specified that award of any prize to the winner shall furthermore depend on the condition precedent that the winner produces and demonstrates to the Organiser the details referred to in this clause (production of ID card) and the letter received from the Organiser, within the time limit set; otherwise, the relevant Prizes shall not be awarded.
   
   The Organiser reserves the right to announce the name of each winner through Facebook, SMS, publication in magazines, newspapers, on the Internet and at the company’s offices. By participating in the Competition, participants are presumed to have granted their consent to such disclosure of their names. The Organiser reserves the right to request from each winner to give his/her written consent, at the free and uninfluenced will of each winner, for the use of their minimum personal data necessary on the Competition webpage or in the context of any other promotional action related to the Competition.
   
   To avoid all doubt, no participant shall be considered, or may claim to be, a final winner, in accordance with these terms, unless delivery of the Prize to him/her has been completed in accordance with the terms contained herein. Any publication of the result of a draw or of the name of an alleged winner on the Competition webpage does not make the result final nor does it establish any claim for any such person.
4. Prize terms and conditions
   4.1. Terms and conditions for awarding of Miles+Bonus miles:
   • The miles awarded are award miles, not tier miles.
   • The Participant’s personal information must match that of his/her Miles+Bonus account.
   • Miles are awarded to a specific winner and cannot be transferred to another person, nor sold or exchanged for cash.
   • The miles will be credited to the accounts of the winners within 10 working days of the date of their notification.
   
   4.2. Terms and conditions of airline ticket prizes:
   • The airline tickets are round-trip, economy class tickets and apply to flights operated by the Organiser and its subsidiary with the distinctive title Olympic Air on a point-to-point basis, and cannot be changed for tickets of another airline.
   • The airline tickets are provided solely and exclusively for transportation of the winners of a stay at Starwood Preferred Guest, if so required, and involves solely and exclusively their transportation to and from the destination of the Prize.
   • Tickets are offered with a Space Confirmed right and may not be issued Open.
   • Airport taxes and charges (as in force at the given time) are included in the offer and are not payable by the winners and their companions.
   • The trip must take place by 31/12/2017. The following periods are excluded: 24-28/2/2017, 20-26/3/2017, 10-18/4/2017, 29/4/2017-2/5/2017, 2/6-6/6/2017, 10/07/2017 - 05/09/2017, 26/10/2017 - 29/10/2017, 14/12/2017-08/01/2018.
   • Booking and issuing of air tickets will be subject to availability of seats on the desired travel dates.
   • Airline tickets will only be booked and issued after the winner contacts the company’s ticket issuing office at the email address servicingoffice@aegeanair.com or by calling +30 210 6261709.
   • Airline tickets may be changed only as regards the departure dates or times of the flights. In the event of a change being made after the ticket has been issued, there will be a reissue fee of twenty Euro (20€). Under no circumstances can the route or class of the ticket be modified.
   • It is explicitly agreed that the Prizes may not be sold or exchanged for cash.
   • The air tickets must be used on the same flight, on the same day and at the same time by both the winner and the companion of his/her choice. The tickets are only valid for flights operated by the Organiser or its subsidiary with the distinctive title Olympic Air, and cannot be changed for tickets of another airline.
   • The Airline’s liability is limited in accordance with the applicable Greek and International legislation. The Organiser may modify the flight schedule without warning.
   
   4.3. Terms and conditions for Hertz Autohellas prizes:
   • The car rental must take place by 31.12.2017. The 04.08.2017-20.08.2017 period is excluded.
   • Car rental winners may only redeem their prize after contacting Hertz Autohellas’ booking department by calling +30 210 6264444, at least 15 days before the preferred rental date.
   • Booking is subject to restrictions on availability on the preferred rental dates.
   • The redemption of the prize is subject to Hertz Autohellas’ car rental terms and conditions.
   
   4.4. Terms and conditions for Starwood Preferred Guest:
   • Both the booking and the stay must take place up to and including 31.12.2017.
   • The booking is subject to restrictions on room availability on the preferred dates per hotel.
   • After acceptance of the prize by the winner, Aegean will provide his/her name and email to Starwood Preferred Guest so that the hotel can contact him/her and deliver the prize.
   • The following periods are excluded as regards Vedema Resort in particular: 10.05.2017 – 15.05.2017 and 16.09.2017 – 07.10.2017.
   
   4.5. Terms and conditions for Cosmote prizes:
   • Aegean undertakes to send the prize to the winner at its own expense, to an address verified by the winner in writing, within 10 working days after confirmation of acceptance of the prize.
   
   4.6. Terms and conditions for the Duty Free prizes:
   • The gift voucher must be redeemed up to and including 31.12.2017.
   • The gift voucher can be used only once and the whole amount must be redeemed in one day with products of an equal value. If the winner selects items of a higher value, then he/she must cover the difference. If the items are of lower value, the difference is not refunded in cash. The winner must show his/her personal Miles+Bonus card and the gift voucher at the counter.
   • The gift voucher can be redeemed at any Hellenic Duty Free Shops in Greece.
   • If the winner is travelling, there is no restriction on the products that he/she can purchase from Hellenic Duty Free Shops in Greece.
   • If the winner is not travelling, then he/she can redeem the gift voucher exclusively at the Hellenic Duty Free Shops located at Athens International Airport. The winner must contact Ms. Maria Katsipanou by calling +30 210 3531271 to arrange a visit to Hellenic Duty Free Shops and select the items he/she wishes. Tobacco and liquor products are excluded in this case.
   • Gift vouchers are personal and can only be exchanged for Hellenic Duty Free Shops products, not for cash.
   • Aegean undertakes to send the gift voucher to the winner at its own expense, to the address provided by the winner on his/her Miles+Bonus account, within 10 working days after confirmation of acceptance of the prize.
5. Date of start-end of Competition/promotion – Duration
   The Competition / Promotion will start at 14:00 hours on Thursday, 08 December 2016 and will end at 12:00 hours on Monday, 09 January 2017. The Competition computers (including any automated subsystems – count-down web tools made available to the Organiser) shall be the official timer of the Competition determining the Start Time, the End Time as well as the time an entry in the Competition is actively sent. It is hereby explicitly specified that, after the end date and time of the aforesaid Competition/promotion, as announced in the terms of use of the Organiser’s page and posted on Aegean’s website during the last Competition procedure, no participation shall be accepted by, or be binding upon, the Organiser as far as participation in due time is concerned.
6. Change of terms and conditions of use:
   The Organiser reserves the right to amend these terms at its discretion, informing visitors/users about any amendments and changes through the Competition/promotion webpage at www.aegeanair.com
7. EXPRESS DECLARATION – CONSENT – ACCEPTANCE BY THE PARTICIPANTS
   All participants in the Competition hereby fully and unreservedly accept these terms and conditions of use. Persons who do not accept the terms and conditions of use should not participate in the Competition. Furthermore, all participants explicitly and unreservedly acknowledge, state and accept that:
   (a) the personal data provided in the context of this promotion may not belong to any third party, whether a natural person or legal entity, but only to themselves;
   (b) they are over the age of 18;
   (c) their privacy is neither violated nor degraded in any manner whatsoever due to their participation in the Organiser's promotion;
   (d) they do not infringe personal data or privacy rights of any third party;
   (e) they do not infringe intellectual property rights of any third party;
   (f) they expressly consent and allow the Organizer to use their personal data (full name, telephone, e-mail address) for the purposes of the Competition;
   (g) they grant their consent and authorisation to the Organiser to promote the Competition and its results through the print and electronic press and through the Internet for its entire duration. The Organiser reserves the right to use and publish any news relating to the conduct of the Competition;
   (h) they grant their consent and authorisation for exploiting any relevant event through advertising, without requiring any further notice or any compensation. The Organiser also reserves the right to publish audiovisual material from the draw and the Prize-giving event.
8. Publicity

9. Withdrawal of Notice – Amendment of Terms - Liability
   The Organiser shall be entitled to withdraw the Competition notice, in whole or in part, or to amend these terms (including the duration of the Competition and the dates of conduct of the draws), or to change the Prizes offered during or after the Competition. In this case the Organiser shall bear no liability whatsoever for any compensation with regard to the winners of that draw. The Organiser shall bear no liability under any circumstances for any direct or indirect losses, expenses or costs which may arise from any interruption, malfunction, delay or any other reason, concerning the Competition prizes. Furthermore, the Organiser hereby waives all liability, whether criminal or civil, to any winner or third party, for any accident and/or loss and/or bodily injury or material damage that may occur to the winners, directly or indirectly, relating to the Prizes or arising from any other cause. It is expressly understood that, after the end of this Competition or after the new date that may be set following any postponement or change in the duration of the Competition, entries shall no longer be possible and any entries submitted shall automatically be considered null and void and shall not be binding on the Organiser and/or any other third party. In that case, by participating in this promotion, participants irrevocably accept that they do not acquire any right or claim against the Organiser nor do they become entitled to demand continuation of the Competition that has ended or delivery of the Prizes not awarded or any further compensation. Participants shall neither have nor acquire any rights whatsoever in respect of the trade marks, names, marks, logos and other insignia of the Organiser.
10. 10. Personal Data - EXPRESS Consent: Regarding the Organiser
    Participation of any person in this Competition implies the participant's automatically unreserved consent to the Organiser responsible for monitoring the competition using their details, to create personal data files (personal data). The database created as a result of this Competition may be used by the Organiser for promotional purposes in the future, to promote its own services. Participants in the Competition agree to the Competition database being handed over by the Organiser to the company responsible for monitoring the Competition and vice versa.
11. 11. Applicable Law – Jurisdiction
    These terms and conditions and all types of contractual and non-contractual relations arising as a result of their implementation shall be governed by Greek law for all participants. Any dispute to arise in the future in relation to this Competition shall be referred exclusively to the Courts of Athens, including by non-permanent residents of Greece.
